Terms of Service

The rules of the road for using our website and ordering our goods.

These Terms of Service (the "Terms") govern your use of tucker2015.com (the "Site") and your purchase of any goods offered by Marlowe & Tucker Apothecary Co., a sole proprietorship registered in Newark, New Jersey, owned by Antonio Kline ("we," "us," "our"). By using the Site or placing an order you agree to these Terms. If you don't agree, please don't use the Site.

1. Eligibility

You must be at least eighteen years old, or the age of majority in your jurisdiction, to place an order. By placing an order you confirm that the information you give us is accurate, that the payment method you use is yours to use, and that you are not buying for resale unless you have first arranged a wholesale account with us in writing.

2. Orders and acceptance

When you place an order — by phone, email, our contact form, or in person at the studio — we will confirm receipt and then either accept the order in full, propose a substitution if an item is out of stock, or decline (rarely). The order is considered accepted only when we send you a confirmation email or hand you a paper receipt. Prices and availability on the Site are subject to change without notice and may be corrected if posted in error.

3. Pricing, taxes and shipping

Prices on the Site are in U.S. dollars and do not include applicable sales tax, which we add at checkout for New Jersey deliveries at the prevailing state rate (currently 6.625%). We ship via USPS and UPS within the United States and to Canada. Standard U.S. shipping is a flat $7; orders over $65 ship free. We are not responsible for customs duties on international shipments.

4. Returns, refunds and exchanges

If a product disappoints for any reason within sixty (60) days of delivery, write to us at privacy@tucker2015.com and we will refund the full purchase price including the original shipping. You do not need to return the unused portion. Damaged-in-transit items are replaced at our cost; just send us a short note describing the damage.

5. Use of the Site

You agree not to: (a) use the Site to violate any law; (b) attempt to gain unauthorized access to our systems; (c) scrape or harvest content for resale; (d) interfere with the operation of the Site, its security features, or any other user's use of it; or (e) post or send anything that is unlawful, defamatory, infringing, or harmful. We may suspend or block access to the Site at any time and for any reason if we reasonably believe it is being misused.

6. Intellectual property

The Site — its design, code, photography, illustrations, copy, the names "Marlowe & Tucker," our product names, and our logo — is the property of Marlowe & Tucker Apothecary Co. and is protected by United States copyright and trademark law. You may share short excerpts and link to the Site freely; you may not republish substantial portions of the writing, the photography, or the catalog without our written permission.

7. Product information and health disclaimer

Our products are toiletries, herbal teas, candles, and home fragrances. They are not medicines and have not been evaluated by the U.S. Food and Drug Administration. They are not intended to diagnose, treat, cure, or prevent any disease. If you are pregnant, nursing, taking medication, or have a known allergy, please consult your physician before use. Each product lists every ingredient by name on the package and on its product page; please review the list carefully before use.

8. Disclaimers and limitation of liability

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, and non-infringement. In no event will Marlowe & Tucker Apothecary Co., its owner, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site or our products, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of these Terms shall not exceed the amount you paid us in the twelve months preceding the claim, or one hundred U.S. dollars, whichever is greater.

9. Indemnity

You agree to indemnify and hold harmless Marlowe & Tucker Apothecary Co. and its owner from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the Site or our goods.

10. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. Any dispute that cannot be resolved by good-faith correspondence shall be brought exclusively in the state or federal courts located in Essex County, New Jersey, and you consent to the personal jurisdiction of those courts.

11. Changes

We may update these Terms from time to time. The updated version will be posted at this URL with a new effective date. Continued use of the Site after an update constitutes acceptance of the revised Terms.
